Ki-Carma Garden Products (“Ki-Carma”, “we”, “us” or “our”) respects your privacy. This policy explains what personal information we collect, why we collect it, how we use and disclose it, and how you can access or correct it.
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy applies to this website (kicarma.com.au) and to our dealings with customers, retailers, distributors, suppliers and enquirers.
1. What personal information we collect
We only collect personal information that we reasonably need. Typically this includes:
- Contact details — your name, business or trading name, email address, phone number and postal or delivery address.
- Enquiry details — the content of messages you send through our contact form, by email, or over the phone, including any product, trade account or technical information you choose to include.
- Business and account information — where you are a retailer, distributor or trade customer, records relating to orders, deliveries, accounts and correspondence.
- Technical information — when you visit this website, our hosting and security providers automatically record information such as your IP address, browser type, device type, the pages you request and the date and time of the request.
We do not collect sensitive information (such as health, racial or ethnic origin, or political or religious beliefs) and ask that you do not send it to us. We do not collect credit card or payment details through this website — no products are sold on this site.
2. How we collect personal information
We collect personal information:
- directly from you, when you complete our contact form, email us, call us, or deal with us as a customer or supplier;
- automatically, through the technical logs kept by our website hosting and security providers;
- from third parties, such as a retailer or distributor who passes on an enquiry, or publicly available business sources, where it is unreasonable or impracticable to collect it from you directly.
You can deal with us anonymously or under a pseudonym where it is lawful and practicable to do so — for example, a general product question by phone. In most cases, though, we will need your contact details to answer you.
3. Why we collect, hold and use personal information
We use personal information to:
- respond to your enquiries and provide product and technical information;
- direct you to a stockist or distributor who can supply the products you are after;
- set up and administer trade and retail accounts, process and deliver orders, and issue invoices;
- maintain our business records and manage our relationship with you;
- improve our products, our website and our service;
- meet our legal, regulatory, safety and record-keeping obligations.
We will only use your personal information for the purpose it was collected, a related purpose you would reasonably expect, a purpose you have consented to, or a purpose otherwise permitted or required by law.
4. Cookies and website tracking
This website does not use advertising cookies, analytics cookies or third-party tracking pixels, and we do not build advertising profiles from your visit.
Some cookies or similar storage may be set by the services that keep the site running and secure — in particular the Cloudflare Turnstile check on our contact form, which is used to distinguish real enquiries from automated spam. Pages that embed a Google map, and pages that load our web fonts from Google Fonts, cause your browser to make a request to Google, which Google may log. Those services are covered by their own privacy policies.
You can block or delete cookies in your browser settings. Blocking cookies may prevent the contact form from being submitted.
5. Who we disclose personal information to
We may disclose personal information to:
- Our service providers — including our website host and security provider (Cloudflare), our transactional email provider (Postmark), and providers of accounting, IT, logistics and professional services. They may only use the information to provide those services to us.
- Retailers, distributors and transport providers — where it is necessary to answer your enquiry, direct you to a stockist, or fulfil and deliver an order.
- Others as required or authorised by law — including regulators, courts and law enforcement, or where necessary to protect the safety of any person or to enforce our legal rights.
We do not sell, rent or trade personal information.
6. Overseas disclosure
Some of our service providers store or process information on servers outside Australia. In particular, our website hosting and security provider (Cloudflare) and our email delivery provider (Postmark) operate infrastructure in the United States and other countries. Where we disclose personal information to an overseas recipient, we take reasonable steps to ensure it is handled consistently with the Australian Privacy Principles.
7. Direct marketing
If we send you product updates or other marketing material, we will only do so where you would reasonably expect it or you have consented, and every message will include a way to opt out. You can also ask us to stop at any time by emailing [email protected]. We comply with the Spam Act 2003 (Cth).
8. Security and storage
We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. Information is held in our business systems and with the service providers described above, protected by access controls and encryption in transit.
No method of transmission over the internet is completely secure. While we do our best to protect your information, we cannot guarantee the security of any information you send us over the internet.
We keep personal information only for as long as we need it for the purposes described in this policy, or as required by law, after which we take reasonable steps to destroy or de-identify it.
9. Accessing and correcting your information
You can ask us for access to the personal information we hold about you, and ask us to correct anything that is inaccurate, out of date, incomplete or misleading. Send your request to [email protected] or write to the address below.
We may need to verify your identity before acting on a request. We will respond within a reasonable period. If we refuse access or a correction, we will tell you why in writing and explain how you can complain.
10. Data breaches
If we become aware of unauthorised access to, or disclosure or loss of, personal information that is likely to result in serious harm, we will investigate and, where the Notifiable Data Breaches scheme applies, notify affected individuals and the Office of the Australian Information Commissioner (OAIC).
